Statutory Role

Manukau Institute of Technology (MIT) is a polytechnic pursuant to section 162 of the Education Act 1989 (the Act).

The object of the Act is to give tertiary education institutes (TEIs) as much independence and freedom to make academic, operational, and management decisions as is consistent with the nature of the services they provide, the efficient use of national resources, the national interest, and the demands of accountability.

Section 159ABA outlines the framework for planning, funding, and monitoring in the tertiary education sector:

(1) The Minister of Education issues a Tertiary Education Strategy (TES) setting out the Government’s long-term strategic direction for tertiary education; and its current and medium-term priorities for tertiary education. The long-term direction addresses economic, social and environmental goals, as well as the development aspirations of Maori and other population groups.

(2) The Minister determines the appropriate funding framework which is implemented by the Tertiary Education Commission (TEC). The TEC is also responsible for:

  • the financial and operational performance of TEIs;
  • advising the Minister on appointments to TEI councils;
  • providing advice to the Minister on activities and performance (both financial and nonfinancial) of TEIs; and
  • implementing interventions under the Education Act 1989.

(3) To access funding, MIT is required to prepare a plan, in consultation with its stakeholders, which is submitted to the TEC for approval. Once approved, the TEC’s role is to monitor MIT’s performance to determine if it is achieving, or has achieved its outcomes specified in the plan.
