Proactive release of Official Information Act response regarding recruitment processes

Since January 1, 2017, MIT has appointed four out of thirty tier 2 or tier 3 positions without publicly (not internally within MIT) advertising the roles. The details are specified below.

(1) Please list the roles that were appointed without a public recruitment process.

Executive General Manager Student Journey

Executive General Manager Strategy and Support Services

(together, the EGM Roles)

Head of HR

Head of Culture and Development

(2) What, if any, advice did the senior-most HR manager provide to the CEO on not publicly advertising the roles?

Not applicable.

(3) Please provide the reason(s) why the roles were not advertised publicly contrary to the requirements S61 of the State Services Act 1988.

Section 61 of the State Sector Act requires that vacancies are, wherever practicable, notified in a manner sufficient to enable suitably qualified persons to apply for the position.

The roles were not advertised publicly as there was a need to fill the roles urgently due to critical business needs and suitably qualified candidates were available internally. We are satisfied that MIT acted in compliance with the requirements of section 61.

(4) Was the MIT Council, and specifically the MIT Council Chair, advised that the CEO was ignoring the requirements of the State Sector Act on notifying vacancies?

With respect to the EGM Roles, the MIT Council and the MIT Council Chair were notified of the proposed recruitment approach.

(5) If the MIT Council Chair and/or MIT Council was advised, did the Council Chair/Council support the CEO’s actions?

The MIT Council and the MIT Council Chair supported and approved the proposed recruitment approach for the EGM Roles.
